Welcome to Golf Unlimited (“Company”, “we”, “our”, “us”)! These Terms of Service (“Terms”) govern your use of our website located at www.virtualgolfunlimited.com (together or individually “Service”) operated by Golf Unlimited.

Our privacy policy also governs your use of our service and explains how we collect, safeguard, and disclose information that results from your use of our web pages.

By accessing or using the service, you agree to be bound by these terms. If you disagree with any part of the Terms, then you do not have permission to access the Service.

1. Definitions

“Customer” refers to any individual or entity that purchases products or services from Golf Unlimited.

“Products” refer to golf simulators and related accessories offered for sale by Golf Unlimited.

“Services” refer to the sale, installation, and maintenance of golf simulators provided by Golf Unlimited.

2. Purchases

2.1 Orders

By placing an order for products through the service, you warrant that you are legally capable of entering into binding contracts.

2.2 Payment

All payments must be made through the payment methods provided on our website. Payment must be received before the dispatch of products. We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product availability, errors in the description or price of the product, error in your order, or other reasons.

3. Installation Services

3.1 Scheduling

Installation services will be scheduled following the confirmation of your order. You will be contacted to arrange a suitable time for installation.

3.2 Site Requirements

The customer is responsible for ensuring that the installation site meets the minimum requirements specified for the product. These requirements will be provided to you at the time of purchase.

3.3 Access
The customer must provide access to the site for installation on the agreed-upon date and time. Any delays caused by the customer’s failure to provide access may incur additional charges.

4. Returns and Refunds

4.1 Return Policy

Products may be returned up to the time of installation. Installation fees are non-refundable.

4.2 Refund Process

Refunds will be processed within 5 days of receiving the returned product. The refund will be made using the same method as the original payment.

5. Warranty and Liability

5.1 Product Warranty

All products come with a manufacturer's warranty. Details of the warranty will be provided with the product. Golf Unlimited does not provide any additional warranties.

5.2 Limitation of Liability

To the maximum extent permitted by applicable law, Golf Unlimited will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Service; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the Service; (iv) any bugs, viruses, Trojan horses, or the like that may be transmitted to or through our Service by any third party; (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service; and/or (vi) the defamatory, offensive, or illegal conduct of any third party.

6. Intellectual Property

The service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Golf Unlimited, and its licensors. The service is protected by copyright, trademark, and other laws of both the country and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Golf Unlimited.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to their conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our service, and supersede and replace any prior agreements we might have had between us regarding the service.

8. Changes to Service

We reserve the right to withdraw or amend our service and any service or material we provide via the service in our sole discretion, without notice. We will not be liable if, for any reason, all or any part of the service is unavailable at any time or for any period. From time to time, we may restrict access to some parts of the service, or the entire service, to users, including registered users.

9. Amendments to Terms

We may amend the Terms at any time by posting the amended Terms on this site. It is your responsibility to review these terms periodically.

PRIVACY POLICY

Personal Information

Below is our Golf Unlimited Privacy Policy:

  • We do not collect cookies
  • We do not collect data
  • We do not store credit card information
  • We do not sell any personal data to anyone

Your privacy is important to us; if there is data or information we want to collect, we will reach out to you and ask your permission first.

With that said, we do use 3rd party vendors for payment transactions (Square) and financing (Hearth), though we do not collect data, our 3rd party vendors might, so if you are asked at any time whether or not you want to allow the collection of data, please know that is for our 3rd party vendors only, we do not have or want access to the data our vendors collect.

Secure Payment Portal

We use the Square secure payment processing platform, which means we do not collect, house, save, or store any of your payment information in our database.

Hearth Financial

We have partnered with Hearth Financial Services to provide our customers with several “Buy Now, Pay Later” options. If you decide to use Hearth Financial Services to finance your dream golf simulator, Hearth Financial Services will need to ask you a few questions and gather some information to help get you the best “Buy Now, Pay Later” plan available. Please know, Golf Unlimited does not have access to any of the information you share with Hearth Financial Services; we at Golf Unlimited are solely focused on helping you with your dream golf simulator, we are not at all interested in collecting and storing data.

CANCELLATION AND RETURN POLICY

We understand life happens, minds change, priorities shift, etc., and the last thing you need is to be questioned, forced to jump through hoops, or not feel heard, so we made sure we kept our installation cancellation and return policies very simple.

You can return any golf simulator package, for any reason, up to the point of installation; once we install your golf simulator though, it is yours to keep; we cannot accept a return. Returns will be processed within 5 days of the return date; we will try to get this done faster for you, but sometimes the weekends create a little delay. You have up to 48 hours prior to scheduled installation to cancel the appointment and receive a full refund, but last-minute cancellations within 48 hours prior to installation will receive a full refund minus the $700 delivery and installation fee.
